General terms and conditions of the Latimport online shop

1. Introductory provisions

These General Terms and Conditions (the “Terms”) govern the relationship between the buyer and the seller when goods are sold through the latimport.sk online shop.

The seller is I2M, s.r.o. A buyer may be a consumer or a business. These Terms also apply to business orders unless a separate agreement or dedicated B2B terms provide otherwise. Consumer-protection rights, including withdrawal without giving a reason, apply only to consumers.

Legal relations are governed by Slovak law, in particular Act No. 40/1964 Coll. (Civil Code), Act No. 513/1991 Coll. (Commercial Code), Act No. 108/2024 Coll. on consumer protection, Act No. 22/2004 Coll. on electronic commerce, Act No. 222/2004 Coll. on VAT, and other applicable law.

2. Orders and conclusion of the contract

The buyer’s order is an offer to conclude a purchase contract. The contract is concluded when the seller sends a binding order confirmation by email.

By submitting an order, the buyer confirms that they have read and agree to these Terms. The Terms are made available before the order is placed.

If an order cannot be fulfilled because goods are unavailable or because of an obvious technical error in price or stock information, the seller will inform the buyer without undue delay. The parties may agree on substitute performance or cancellation. Any payment already received will be refunded in the corresponding amount.

  • Select goods and add them to the cart.
  • Enter contact, billing and delivery details.
  • Choose delivery and payment methods.
  • Review and submit the order using the button that creates an obligation to pay.
  • Receive an order-receipt confirmation by email.

3. Prices and payment terms

Consumer prices are final prices including VAT. Delivery and payment fees are shown separately before submission. B2B prices may follow the applicable business scheme, an individual agreement or a quotation; the summary states whether VAT is included and shows the amount payable.

Price changes do not affect an order already confirmed, except in the case of an obvious technical pricing error communicated without undue delay.

The seller issues an electronic tax document for every order. Invoices, corrective documents and credit notes are sent to the order email address and may also be available in the customer account.

Accepted payment methods

  • Online payment through GoPay using the methods currently offered by the gateway.
  • Cash on delivery or payment on collection where offered, subject to the fee shown in the summary.
  • Another agreed method, particularly for an individual or B2B order.

4. Delivery terms

The delivery period follows the order information or confirmation. If no special period is agreed, the statutory period applies. Dispatch and tracking information is sent by email where available.

The delivery price is shown when the method is selected.

5. Receipt of goods

The buyer must accept the goods at the agreed place and time and inspect the packaging on receipt.

Damage to the packaging should be reported to the seller without undue delay and recorded with the carrier. Signing without reservations confirms that the packaging appeared undamaged.

If a parcel cannot be delivered or is not collected, the seller will contact the buyer to agree on the next steps where possible. Statutory rights remain unaffected.

Title passes after the purchase price is paid in full and the goods are received.

6. Withdrawal from the contract

For a distance contract, a consumer may withdraw without giving a reason within 14 days after receiving the goods. For delivery in parts, the period begins when the final item is received.

During the withdrawal period, the online withdrawal function is continuously and easily available in the website footer and, for signed-in customers, from the order detail. The consumer enters or confirms their name, contract identifier and email address. A reason is optional. After submission, the seller promptly sends a durable-medium acknowledgement containing the statement and the date and time of submission.

An unequivocal withdrawal statement may also be sent to info@latimport.sk or by post to the seller. Goods must be returned within 14 days after the notice to I2M, s.r.o., Nový Majer 30, 926 01 Sereď, Slovakia.

The consumer is liable for diminished value caused by handling beyond what is necessary to establish the goods’ nature and characteristics. Original packaging is recommended where possible.

The seller refunds received payments within 14 days after the notice. For delivered goods, the refund may be withheld until the returned goods arrive, as permitted by law. The original payment method is used unless agreed otherwise.

The refund includes original delivery up to the least expensive standard method offered. The consumer bears the direct return cost unless the seller agrees otherwise.

7. Complaints and liability for defects

For consumer purchases, liability for defects follows the Slovak Civil Code. A defect appearing within two years after delivery may be reported within two months after discovery and no later than the end of the statutory period. For food, the nature, use-by or best-before date, storage and handling are considered.

Submit a complaint through the contact function or info@latimport.sk with proof of purchase, a description and, where possible, a photograph. The seller provides written confirmation and the next steps without undue delay.

Where inspection is needed, the seller specifies delivery. Unless agreed otherwise, use I2M, s.r.o., Nový Majer 30, 926 01 Sereď. The remedy period stated for a consumer complaint may not exceed 30 days unless an objective reason outside the seller’s control justifies longer.

Where repair or replacement applies, the seller bears the costs required by law.

Liability generally excludes

  • Incorrect storage, manipulation or handling after receipt.
  • Mechanical damage caused after receipt.
  • Ordinary wear where relevant.
  • Deterioration caused by expiry of a use-by or best-before period.

8. Personal data protection

Personal data is processed under Regulation (EU) 2016/679 (GDPR) and Slovak Act No. 18/2018 Coll.

9. Final provisions

These Terms take effect when published. Amendments do not apply to orders confirmed before the new version takes effect. Unregulated matters follow applicable Slovak law.

A consumer may ask the seller for a remedy. If the request is rejected or unanswered for 30 days, the consumer may seek alternative dispute resolution under Slovak Act No. 391/2015 Coll. Information is available from the Slovak Trade Inspection at www.soi.sk.

By submitting an order, the buyer confirms that they have read and agree to these Terms.
